Event Ticket Terms and Conditions

1. About these terms

These terms apply to all conferences, workshops and community events, in person and online, run by My Spirited Child Worldwide Pty Ltd (ACN 684 824 039), trading as My Spirited Mind ("My Spirited Mind", "we", "us", "our"). "You" means the person who buys a ticket and anyone who attends on that ticket.

By completing your booking you agree to these terms, so please read them carefully. The version of these terms published at the time you book applies to your booking.

2. Booking and payment

•     A booking is confirmed only once we have received full payment.

•     Prices are in Australian dollars (AUD) for events in Australia and New Zealand dollars (NZD) for events in New Zealand, unless the event page says otherwise. Prices include GST where it applies.

•     Any booking or payment-processing fees are shown before you pay.

•     Only one discount or promotional code may be used per ticket. Codes cannot be combined, and cannot be applied after a booking has been completed.

•     Tickets are emailed within 24 hours of purchase. If yours has not arrived, or you lose it, email us and we will reissue it to the email address used for the booking.

•     Tickets are sold through Trybooking or Evey. Its terms of use also apply to your purchase. If they conflict with these terms about the event itself, these terms apply.

3. Tickets and attendee names

•     Tickets are not issued in a particular person’s name. You can add or change the attendee’s name yourself at any time before the event through your booking confirmation, at no charge.

•     Each ticket admits one person.

•     Because tickets are not named, you are welcome to pass your ticket to someone else if you cannot attend. You must not resell a ticket for more than you paid for it, or use a ticket for advertising, promotions, contests or sweepstakes without our written permission. Tickets resold or used in breach of this clause may be cancelled without refund.

•     Tickets won in a giveaway and NDIS-funded tickets cannot be passed on or resold, and must be used by the person they were issued to.

4. Group and organisational bookings

•     Schools, organisations and groups can buy multiple tickets in one booking. The person who makes the booking manages the attendee names and can change them at any time before the event.

•     If we agree to invoice you or accept a purchase order, payment is due within 14 days of the invoice date and, in every case, before the event. A purchase order alone does not confirm a booking. We may release tickets that have not been paid for by the due date.

•     Section 5 (Refunds) applies to group bookings. If fewer people can attend, you can reassign the tickets to other people instead.

5. Refunds

•     All tickets are non-refundable and cannot be exchanged, except as set out in section 6 or where the law requires. This includes changes in your personal circumstances, being unable to attend, and adverse weather.

•     Booking and payment-processing fees are non-refundable, except where the law requires.

•     Nothing in these terms excludes, restricts or changes any right you have under the Australian Consumer Law or, for events in New Zealand, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, that cannot lawfully be excluded.

6. If we cancel or change an event

•     If we cancel an event before it begins, or change its date, venue or format (including moving between in-person and online), we will email you. You can choose to: (a) attend the changed event; (b) transfer to another My Spirited Mind event, up to the face value of your ticket; or (c) receive a refund of the ticket price.

•     Please tell us your choice within 14 days of our email. If we do not hear from you, your ticket will stay valid for the changed event. If the event is cancelled and not rescheduled, we will refund you automatically.

•     Programmes can change. We may replace a speaker, change session times or rooms, or adjust the programme where needed. These changes do not count as a cancellation or change under this section.

•     If an event has to be stopped after it has begun for reasons outside our control, we will offer you access to recordings of the affected sessions where available, or a credit towards a future event. You will not receive a refund unless the law requires one.

•     Refunds are paid to the original payment method within 10 business days of receiving your choice.

7. Accessibility and support

•     Our events are created with and for neurodivergent people, and the room will be full of them. You can take a break, move around, or step out and come back at any time. You do not need to ask.

•     Companion Card holders: your companion attends free. Buy your own ticket, then email a copy of your purchased ticket and your Companion Card to hello@myspiritedmind.com before the event. We will issue a free companion ticket.

•     If you need an adjustment to take part, contact us before the event and we will do what we reasonably can. Some venue features are outside our control.

8. Age requirements

•     Our events are for people aged 14 and over. Children under 14 cannot attend.

•     Attendees aged 14 to 17 need their own ticket, and must be accompanied by a parent, guardian or responsible adult. That adult is responsible for them at all times.

9. Food and drink

•     My Spirited Mind does not provide food or drink at its events unless the event page says otherwise. Please bring your own or use the options available at or near the venue.

10. Filming and photography

Our events are photographed and filmed. Our Filming & Photography Policy at https://www.myspiritedmind.com/pages/filming-and-photography-policy forms part of these terms. In short:

•     By attending, you agree that we may use photos and footage in which you appear to record and promote our events, without payment to you.

•     If you would rather not be photographed, pick up a no-photo sticker at the registration desk. At online events, keep your camera off. We cannot guarantee you will not appear in wide or background shots.

•     We will not feature an identifiable person under 18 as the focus of promotional material without a parent’s or guardian’s consent.

•     We edit audience questions, comments and chat messages out of recordings we publish or sell.

•     You may take photos for personal use, but must not film, audio-record or live-stream any speaker’s session, and must respect anyone wearing a no-photo sticker.

11. Online events

•     Your ticket admits one person, and your login link is personal to you. It must not be shared. You may not record, download, stream or redistribute any part of an online event.

•     You will need a computer, tablet or phone with a stable internet connection, an up-to-date web browser and the Zoom app, and speakers or headphones. Please test your set-up before the event. Your display name and any chat messages may be visible to other attendees.

•     If your own device or internet connection fails, we cannot offer a refund. Where replay access is included, you can catch up on what you missed.

•     If our platform fails and a session cannot go ahead as planned, we will reschedule it or provide a recording.

•     Where replay access is included, it is available for the period stated on the event page. Some sessions may be left out of the replay at the speaker’s request. Where we know this in advance, we will say so on the event page before you book.

12. Certificates of attendance

•     Certificates of attendance are not personalised (they do not show your name) and are emailed to the booking email address after the event.

•     Please check with your professional body whether attendance counts towards your continuing professional development (CPD) requirements.

13. General information only

•     Content presented by speakers, MCs, panellists, exhibitors and sponsors is general information and shared lived experience. It is not medical, clinical, psychological, legal, financial or other professional advice, and it is not tailored to you. Please seek advice from a qualified professional about your own or your child’s circumstances.

•     Views expressed at our events are the speakers’ own and do not necessarily reflect ours.

•     We do not endorse exhibitors, sponsors or their products and services. Any purchase you make from them is between you and them.

14. Intellectual property

•     Presentations, slides, handouts, workbooks, recordings and other event materials belong to us or to the speakers. They are for your personal, non-commercial use only. You must not copy, share, sell, publish or upload them to any website, platform or AI tool without written permission.

15. Behaviour at our events

•     We want everyone to feel safe and welcome. We understand that neurodivergent people communicate, move and regulate in many different ways. This will never, on its own, be a reason to ask someone to leave.

•     We may refuse entry to, or remove from an event, anyone whose behaviour is unlawful, threatening, harassing or discriminatory, anyone who is intoxicated, or anyone who continues to seriously disrupt the event after being asked to stop. Serious incidents may result in exclusion from future events. No refund applies in these cases.

16. Privacy

•     We collect your name, contact details and booking information so we can manage your ticket and your attendance. We also collect any access or support needs you choose to tell us about, and use them only to support you. We handle personal information in line with the Privacy Act 1988 (Cth) and, for New Zealand events, the Privacy Act 2020 (NZ).

•     We do not sell your personal information. We do not give your contact details to exhibitors, partners or speakers unless you agree to it, for example by leaving your details at their stand or opting in when you book.

•     You can opt in to our newsletter when you book and unsubscribe at any time. Receiving marketing emails is not a condition of buying a ticket.

17. Limits on our liability

Except as required by law, and except to the extent caused by our negligence, My Spirited Mind is not liable for any loss, inconvenience, damage, additional expense, injury, delay or other claim in relation to:

•     changes to event information, the programme, speakers or dates, including the cancellation or rescheduling of events (your options in that case are set out in section 6);

•     acts or omissions of independent contractors or others outside our control who supply products or services in connection with events;

•     unknown or unforeseen defects in any venue, equipment or material used in connection with events;

•     venue policies or legal regulations, including dress standards, restrictions on cameras and recording devices, the responsible service of alcohol and safety regulations;

•     events that are unforeseeable or could not be prevented by reasonable diligence on our part, including war, fire, flood, unusually severe weather, pandemic, acts of government, acts of terrorism, accidents, equipment failure, industrial action, and failures of telecommunications or delivery providers beyond our reasonable control; or

•     loss of, damage to or theft of personal belongings at an event, except to the extent caused by our negligence.

18. Complaints

•     If something has gone wrong, email us at hello@myspiritedmind.com. We will acknowledge your complaint within 5 business days and aim to resolve it within 20 business days.

•     If we cannot resolve it, you may contact Consumer Affairs Victoria or, for New Zealand events, the Disputes Tribunal of New Zealand.

19. General

•     We may update these terms from time to time. The version published when you booked applies to your booking.

•     If any part of these terms is found to be invalid or unenforceable, that part will be removed and the rest of the terms will continue to apply.

•     These terms are governed by the laws of the State of Victoria, Australia. For events held in New Zealand, nothing in these terms limits any right you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or the Privacy Act 2020 that cannot lawfully be excluded.
